Terms of Service

By using SurgeScribe you confirm you have read and agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

We may update these Terms. We will tell you about material changes by email or in the app, and continuing to use the Service afterwards means you accept the update.

Using SurgeScribe requires an account. By registering you agree that:

• You are at least 18 years old.
• The information you give us is accurate and current.
• You will keep your credentials confidential and are responsible for what happens under your account — including anything an assistant you connected does with it.
• You will tell us at contact@surgescribe.com straight away if you think someone else has access to your account.
• You will not create an account on someone else's behalf without their permission.

SurgeScribe is designed to be driven by an AI assistant such as ChatGPT or Claude over MCP. When you authorise one, it receives a token that can read and change your projects and spend your credits on renders and generation.

• Work done by an assistant you authorised is your work, and the credits it spends are spent.
• Only connect assistants you trust, and only give them the access you intend.
• You can see and revoke every connection under Settings → Account → Connected apps. Revoking takes effect immediately.
• Your use of the assistant itself is governed by that provider's terms, not ours.

SurgeScribe runs on prepaid credits. There is no subscription and no recurring fee. You buy credits and spend them on the work that costs us money — rendering, preview frames, and generation.

How credits work

• Credits are added to your balance as soon as a payment succeeds.
• Credits never expire and are not reset monthly.
• A pack's storage allowance and export quality last 30 days from your most recent purchase; buying any pack starts the 30 days again. After that your account moves to the Free allowance and you keep your credits.
• If you do not buy another pack within 30 days of your plan ending, your stored files above the Free allowance are permanently deleted, oldest first. We show the date on your dashboard and email you before it happens. Your account, credits and projects are kept.
• Work is charged before it starts, so an insufficient balance is refused up front rather than partway through.
• Failed work is refunded automatically. If a render or generation does not produce a file, its credits go back to your balance.
• Completed work is not refundable. Once an export or generation has produced its output, those credits are spent.
• Unused credits on a deleted account are forfeited.

Prices can change

Per-second rates for rendering and generation are set against what our vendors charge us, and can change if their pricing changes. The current rates are always published on our pricing page. A change never affects credits you have already spent, and never retroactively charges you more for work already done.

Payments and refunds

Payments are handled by Dodo Payments; we never hold your card details. If a payment succeeds but credits do not arrive, contact contact@surgescribe.com within 14 days and we will put it right.

Use SurgeScribe lawfully. You must not use it to:

• Create content that is illegal, defamatory, harassing, abusive, or fraudulent
• Create sexual content involving minors, or non-consensual intimate imagery of anyone
• Create a video that depicts a real, identifiable person saying or doing something they did not, in a way intended to deceive
• Infringe anyone's copyright, trademark, likeness or other rights — including by uploading footage, music or images you do not have the right to use
• Distribute spam or unsolicited bulk messaging
• Reverse engineer, decompile, or extract the platform's source code
• Scrape or automate access to the Service outside the documented MCP interface
• Disrupt or interfere with the Service, its rendering infrastructure, or other users

Breaking these rules can lead to immediate suspension or termination without refund.

You own your content. Your projects, the assets you bring or generate, and the videos you export belong to you.

• We claim no ownership over anything you create with the Service.
• You grant us a limited licence to store, process and display your content solely to provide the Service to you — storing your files, rendering your video, showing you a preview.
• We do not train models on your content, show it to other users, or disclose it to third parties beyond the processors listed in our Privacy Policy.

You are responsible for having the rights to whatever you put into a project — footage, music, images, logos, and the people who appear in them.

SurgeScribe renders deterministically: the same document always produces the same film. Generation is different — images, voiceover, music and footage come from AI models, and those are probabilistic.

• Review what you publish. Generated imagery, speech and footage can contain errors, artefacts, or unintended likenesses.
• We make no guarantee that generated output is accurate, original, or fit for any particular purpose.
• Publishing is your decision and your responsibility. We are not liable for the consequences of what you choose to post.
• Generated output may resemble output produced for someone else. Review and adapt before publishing.
• Generation is also governed by the model provider's own terms, which apply on top of these.

Rendering runs on sandboxed infrastructure and takes minutes rather than seconds. It continues in the background after your request returns, and you collect the result from the job or the project's export history.

• Render times vary with length, resolution and load. We do not guarantee a completion time.
• A render can fail for reasons outside our control. When it does, its credits are refunded.
• We may set reasonable limits on render length, file size and request rate to keep the service available for everyone.
• Exported files are stored for as long as your account holds the project. Keep your own copy of anything you rely on.

The SurgeScribe name, logo, design, software and rendering system are ours and protected by intellectual property law. These Terms grant you the right to use the Service, and nothing more.

Close your account any time from Settings, or by emailing contact@surgescribe.com. See our Data Deletion page for what happens next.

By us

We may suspend or terminate an account, with or without notice, for a breach of these Terms, for fraud, or where its use puts the Service or other users at risk.

What happens

• Your data — projects, assets, exports and account information — is permanently deleted within 30 days.
• Unused credits are forfeited and are not refundable.
• Terms that should outlast the account, such as liability limits, remain in effect.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent the law allows, we disclaim any warranty:

• Of merchantability, fitness for a particular purpose, or non-infringement
• That the Service will be uninterrupted, timely, or error-free
• That generated content will be accurate, original, or suitable for your purpose
• That the Service will meet your specific business requirements or produce any particular result

TO THE FULLEST EXTENT PERMITTED BY LAW, SURGESCRIBE AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, including:

• Loss of profits, revenue or data
• Business interruption or lost opportunity
• Loss of goodwill or reputation
• Any indirect loss arising from your use of, or inability to use, the Service

Where a jurisdiction does not allow these exclusions, our liability is limited to the maximum extent that jurisdiction allows.

In every case, our total liability for any claim relating to the Service will not exceed what you paid us in the three months before the claim.

These Terms are governed by the laws of the jurisdiction in which SurgeScribe is registered, without regard to conflict-of-law rules. Disputes that cannot be resolved informally go to the exclusive jurisdiction of the courts there.
